Labor law

As a special law between employee and employer, it is a subject that almost everyone comes into contact with on a daily basis.

Jurisprudence plays a special role here, as the legislature has not conclusively regulated many issues and the gaps in the event of a dispute are closed by the courts.

Typical problems include the review of employment contracts (effectiveness of fixed-term contracts, etc.), terminations, warnings and wage claims (including Christmas and holiday bonuses). We advise both employees and employers on all issues relating to protection against dismissal and are at your side as a contact person throughout the entire protection against dismissal process. We are happy to help you with the drafting of employment contracts.

When the employment relationship ends, the employee has a legal right to be issued with a qualified reference. Disputes between employer and employee often arise in this area. We are available to answer any questions you may have about references.

The warning is an important sanction in the area of labor law and is not regulated by law. Despite the lack of legal regulations, the warning is subject to substantive and formal requirements in order to have the intended effect. We will be happy to check the effectiveness of the warning for you.
If there are disputes arising from the employment relationship, legal recourse to the labor courts is open. Since, due to the legal provisions, the out-of-court attorney fees in the first instance proceedings must be borne by each party themselves and no costs are reimbursed by the opponent even in the event of a win, competent pre-trial advice is of particular importance for the purpose of avoiding disputes.
