Real estate law

Property and real estate law deals with the rights to a property and the legal relationships between the owner of a property and third parties. Rights of third parties to a property include easements (this includes rights of way and overpass rights), usufruct rights (the right to collect the income, e.g. rents or leases from a property) or land charges (mortgages or land charges with which a real charge is created as security for payment claims). The WEG law regulates the relationships between several property owners (apartment or part owners) of a property on which the building is built.
There are community-related rights to a property and the buildings on it. In addition to the German Civil Code (BGB), the law on home ownership and the long-term right of residence (WEG) form the legal basis.

We represent those involved in the problem areas that arise in these legal areas. We advise in connection with the conclusion of property purchase contracts and the establishment and surrender of the rights mentioned above. We support you in asserting claims arising from such rights or contracts both in and out of court. We represent apartment owners in asserting and defending claims within the condominium association.
